Terms of Service

These Terms of Service (“Terms”) govern your use of the Odigo app and the website at getodigo.com (together, the “Service”). Please read them carefully.

1. Acceptance of these Terms

By downloading, accessing, or using Odigo, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. If you use Odigo on behalf of an organization, you represent that you are authorized to bind it to these Terms.

2. The Service

Odigo helps drivers in the Philippines discover fuel and EV charging locations, view price information, compare nearby stations, save favorites, and share observations such as price reports and reviews. The Service is provided for informational purposes to help you make your own decisions.

3. Prices and information are estimates, not guarantees

Prices in Odigo come from three kinds of sources, each labeled in the app:

Fuel and electricity prices change frequently and vary by station, time, payment method, and promotions. Odigo does not guarantee that any price, availability, location, amenity, or charger status shown is accurate, complete, or current. Always confirm the actual price and availability at the station before relying on it. Odigo is not a party to any transaction between you and a station or charging operator.

4. Your account

Some features require an account. You agree to provide accurate information, to keep your sign-in credentials secure, and to be responsible for activity under your account. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account. Notify us promptly of any unauthorized use.

5. Your content

“Your content” means the price reports, reviews, ratings, amenity updates, photos, and other material you submit. You retain ownership of your content. By submitting it, you grant Odigo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, and display that content within the Service and in related promotion of the Service, including after your account is closed where the content has become part of shared station data.

You represent that you own or have the right to submit your content, that it is accurate to the best of your knowledge, and that it does not infringe anyone’s rights or break any law. Do not submit personal or sensitive information about yourself or others in public contributions.

6. Moderation

To keep station data trustworthy, we may review, edit, reject, hide, or remove any content, and we may reverse Street Cred points associated with content that is later flagged or found to violate these Terms. We may use automated tools (including text recognition on uploaded photos) and human review. We are not obligated to monitor content but may do so at our discretion.

The Odigo name, logo, app, website, design, and software are owned by Odigo and protected by intellectual-property laws. Except for your own content and rights granted to you here, nothing in these Terms transfers any ownership to you. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service except as the law expressly permits.

9. Third-party data and services

Station and charger locations are partly derived from OpenStreetMap contributors and are licensed under the Open Database License (ODbL); map data © OpenStreetMap contributors. Reference prices may draw on public Department of Energy data. The Service also relies on third-party providers such as Apple, Google, and our infrastructure vendors, whose own terms may apply. Odigo is not responsible for third-party content or services.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. You use the Service and rely on any information in it at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, Odigo and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on prices, availability, locations, or other information shown in the Service, even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited under Philippine law.

12. Termination

You may stop using Odigo and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination — including content licenses for shared data, intellectual property, disclaimers, and limitation of liability — will continue to apply.

13. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. You agree that the courts of the Philippines will have jurisdiction over any dispute arising from these Terms or the Service, subject to any mandatory consumer-protection rights you may have.

14. Changes to these Terms

We may update these Terms as Odigo evolves. When we make material changes we will update the date above and, where appropriate, notify you in the app. Continued use of the Service after an update means you accept the revised Terms.
